Terms of Service

These Terms of Service ("Terms") govern your use of the Discord bots and related services provided by VantaNull / Apocrypha Sys ("we," "us," or "our"), including but not limited to Truth or Dare, Whodunit, Mainline, Babble, Swatchie, and any future bots released under these brands (collectively, the "Bots").

By installing, using, or interacting with the Bots in any Discord server, you agree to these Terms. If you do not agree, do not use the Bots.

1. Description of Service

The Bots are Discord applications that provide games, utilities, and related features to Discord servers and users. Core functionality is provided free of charge. Some Bots may offer optional premium features available for purchase, as described in section 6.

2. Eligibility

You must meet Discord's minimum age requirement (13 years old, or 16 in jurisdictions where local law requires a higher age) to use the Bots. By using the Bots you confirm that you meet this requirement.

3. User Responsibilities

When you use the Bots, you agree:

• To comply with Discord's Terms of Service (https://discord.com/terms) and Community Guidelines (https://discord.com/guidelines).
• To use the Bots only for their intended purposes.
• Not to abuse, exploit, or attempt to break the Bots.
• Not to use the Bots to harass, harm, or violate the rights of other users.
• Not to reverse engineer, decompile, or otherwise interfere with the Bots' code or infrastructure beyond what is permitted by applicable law.

4. Server Administrator Responsibilities

If you install a Bot in a Discord server you administer, you are responsible for:

• Ensuring the Bot is used in compliance with Discord's policies and applicable law.
• Moderating any user-generated content created through Bot features. This specifically includes content added through commands such as /prompt add, custom configurations, and any content your members generate using the Bot. We do not pre-screen or moderate user-generated content.
• Properly age-restricting (NSFW-labeling) any channels where Bot features may produce or be used to produce adult content, in accordance with Discord's Community Guidelines.
• Ensuring that members of your server understand the Bot is in use, and obtaining any consent required under applicable law.

You acknowledge that user-generated content (such as custom prompts) is created by your server's moderators or members, not by us, and that you are responsible for ensuring such content complies with Discord's Community Guidelines and applicable law.

5. Prohibited Uses

You may not use the Bots to:

• Generate, store, or distribute illegal content of any kind, including content that depicts child sexual abuse, non-consensual sexual content, or any other content prohibited by Discord's Community Guidelines or applicable law.
• Harass, threaten, defame, dox, or otherwise harm any person.
• Engage in spam, scams, phishing, or other fraudulent activity.
• Distribute malware or attempt to compromise the security of any system.
• Violate any applicable law or regulation, whether in Denmark, the European Union, your jurisdiction, or any user's jurisdiction.
• Resell, redistribute, or commercialize the Bots without our written permission.

We reserve the right to suspend or remove the Bots from any server, or to block any user, that we find to be violating these prohibitions, at our sole discretion and without prior notice.

6. Premium Features

Some of our Bots offer optional premium features available through one or more of the following payment platforms:

• Discord Premium Apps (subscriptions and one-time purchases handled natively by Discord)
• SubscribeStar
• Ko-fi
• PayPal
• Stripe

The specific premium offerings and pricing are described within each Bot. Premium purchases are processed by the relevant payment platform under that platform's own terms and policies. Refunds, where applicable, are subject to the payment platform's policies. We will, however, make reasonable efforts to assist with refund disputes where the premium feature has not been delivered as described.

Premium status does not grant you ownership of any content or feature, only the right to use it for the duration of your subscription or, in the case of one-time purchases, for the lifetime of the relevant Bot.

7. Availability

The Bots are provided on a best-effort basis. We do not guarantee uptime, availability, or that the Bots will be free from bugs, errors, or interruptions. The Bots may be modified, suspended, or discontinued at any time, with or without notice, including for technical, legal, or business reasons.

8. Disclaimer of Warranties

THE BOTS ARE PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WITHOUT LIMITATION ANY WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

We do not warrant that the Bots will meet your requirements, operate without interruption, be secure, or be free from errors.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, WE WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF DATA, PROFITS, OR REVENUE, ARISING OUT OF OR RELATING TO YOUR USE OF THE BOTS.

Our total aggregate liability for any claim related to the Bots is limited to the greater of (a) the amount you have paid us for premium features in the 12 months preceding the claim, or (b) 100 DKK.

Nothing in these Terms excludes or limits liability where such exclusion or limitation is prohibited by applicable Danish or EU law (for example, liability for death, personal injury, fraud, or gross negligence).

10. Indemnification

You agree to indemnify and hold harmless VantaNull / Apocrypha Sys and its developer from any claims, damages, losses, or expenses (including reasonable legal fees) arising from your use of the Bots in violation of these Terms or applicable law. This specifically includes claims arising from custom content (such as custom prompts) that you or members of your server create using the Bots.

11. Termination

We may suspend, restrict, or terminate your access to the Bots at any time, with or without notice, if we believe you have violated these Terms or are otherwise misusing the service.

You may stop using the Bots at any time by removing them from your server or by no longer interacting with them. Termination does not entitle you to a refund of any premium subscription, except as required by applicable consumer protection law.

12. Changes to These Terms

We may update these Terms from time to time. The "Last updated" date at the top of this page reflects the most recent revision. Material changes will be announced through our Bots, our website, or our official Discord community. Continued use of the Bots after an update constitutes acceptance of the updated Terms.

13. Governing Law and Disputes

These Terms are governed by the laws of Denmark, without regard to conflict-of-law principles. Any disputes arising under these Terms will be resolved in the courts of Denmark, unless mandatory consumer protection law in your jurisdiction grants you the right to bring proceedings elsewhere.

If you are a consumer in the European Union, you also have the right to use the European Commission's Online Dispute Resolution platform at https://ec.europa.eu/consumers/odr.
